Terms & Conditions

These Terms and Conditions apply to the provision courses offered by Guardian Safety.

  1. Definitions

For the purposes of these Terms: ‘We’ and or ‘Us’ means Guardian Safety who will provide you with the courses/training your ordered. ‘You’ means the customer receiving the courses or the person that has booked the course. ‘Enrol’ means the process of enrolling, booking or ordering a course and the term Enrolment shall be construed accordingly. If you order via the website this will involve you completing the relevant Order form on the website, giving us your personal information and submitting the details to us. You can also order by telephone giving us your payment details and agreeing to proceed with purchase. Phone calls are not recorded where credit card details are taken. Existing commercial customers may avail of a 30-day account based on providing a PO (purchase order) number, accounts must be kept up to date to avail of this service.

  1. Provision of Courses

Once you have booked you will receive confirmation of your booking and it will be delivered to you as per this confirmation. This confirmation is automatic for online bookings and usually within an hour for all others. Guardian Safety reserve the right to deliver course materials in any format. Guardian Safety reserve the right to cancel a training course. If the course is cancelled, Guardian Safety will make contact with the client or client representative and rebook the participant into a future course. If the dates of the rebooked (further) course does not suit the clients the course fee will be fully refunded to the entity that paid the original course fee.

  1. Course Fee

The course fee covers all charges including documentation, administration, certification and moderation. Certain instructor courses will include lunch, information on lunch will be provided in your booking form. Training material will be provided in paper format, USB or via our online secure system by Citrix Podio. You will be required to login and provide a password and email for access to Podio, you will have full control over permissions and can cancel your Podio access at any time.

  1. Methods of Course Delivery

Terms and condition for online training are provided on entry to the online site, for class-based training, should there be insufficient numbers to run this course at the dates booked learners will be moved to the next available dates. Guardian Safety reserves the right to change course dates and delivery times without any prior notification or agreement. If dates do not suit, we will endeavour to arrange dates that suit or Guardian Safety will provide a refund.

  1. QQI Courses – “Preferred Entry Levels” & “Special Requirements”

When students submit their enrolment application form they confirm that they can meet all the relevant “Preferred Entry Levels” & “Special Requirements” as listed on each course. All students will be asked to provide evidence of this after they enrol. Once enrolment has been submitted, no refunds will be provided if students fail to provide evidence of the “Preferred Entry Level” & “Special Requirements” they confirmed during the enrolment on a specific course.

  1. Your Rights to Cancel

Cancellation/Refund conditions/arrangements.

  • Cancellations must be made in writing(email) and reach the event organiser prior to the start of a course subject to the following:
    • 10% of the full course fee will be charged on cancellations received up to 15 calendar days of the original start date of the course.
    • 50% of the full course fee will be charged on cancellations or transfer/reschedule of the course date, received between 14 and 8 calendar days of the original start date of the course.
    • Regrettably, no refunds or transfer of course date will be made if you cancel or reschedule within 7 days before the original start date of the course.
    • If you transfer/rescheduled a course once, you cannot receive a refund or reschedule the second time around.
    • If a learner/participant doesn’t attend a course date without prior cancellation or notification they will be liable to pay a cancellation fee, which is 100% of the course fee.

 Guardian Safety.

Participants should be in the training venue at least 15 minutes before the notified course start time. Participants who are late for a course by more than 15 minutes will not be permitted on the course.
All course materials and exam fees (if applicable) are included in course fees. If participants are required to bring any further course materials they will be informed in advance of the course.

  1. Course Study Timeframe

The time allowed to complete each course is detailed on this website, this includes projects. Extension to this time may be requested in exceptional circumstances but are allowed at the sole discretion of Guardian Safety. There may be additional charges for time extensions. All students who do not complete courses in the timeframe listed on this website, may be completely removed from the Active student list if no formal extension has been approved by Guardian Safety. If you have been removed from the Active student list, then you may be liable for complete re-enrolment and full course payments again upon reactivation.

  1. Quality

We will provide the courses in accordance to each course description as detailed on our website. All representations, warranties and / or commitments not expressly set out in these Terms and Conditions (whether implied by law, conduct, statute or otherwise) are hereby excluded to the maximum extent permissible at law. We reserve the right to reformat any course material and website information at any time.

Safe Pass Cards

It can take 6-8 weeks for a card to be fully processed. In the interim you will receive a letter of confirmation stating the date of attendance and the instructor name, this letter can be used in the meantime as proof of course completion.  The Safe Pass card will be posted to attendees in the envelope which has addressed by the participant, it is your responsibility to put your address on the envelope, Guardian Safety will not take any responsibility for cards that are sent to the wrong address or lost in the post. If you do not receive your safe pass card you must notify Guardian Safety within a reasonable time frame up to 10 weeks.

  1. Complaints

In the event you are not satisfied with any aspect of your purchase please contact us in writing stating in what respects you are not satisfied and where you feel the content did not match the published contents as displayed on our website. If a refund is agreed you must return all training material, certification and agree not to make copies of said material.

  1. Our Obligations to You

The exclusions and limitations of liability contained in these Terms and Conditions do not apply to: Any loss or damage resulting from death or personal injury caused by our negligence; Loss or damage arising from fraudulent misrepresentation; or Any other losses which may not be excluded or limited by law. In the event of a Postal Dispute or other such events which are beyond our reasonable control we shall make every reasonable effort to get your course to you as soon as is practical.

In no event shall we be responsible to you for any loss of profits, loss of earnings, loss of anticipated savings, loss of revenue or loss of goodwill that you may suffer. Further, in no event shall we be liable to you for indirect or consequential losses that you might suffer. Our maximum aggregate liability to you for any claim is limited to the amount of the course fee paid.

  1. Your obligations to Us

In accordance with Copyright Law you are not permitted to reproduce or modify any part of a course, store it in a retrieval system or transmit it in any form by any means – electronic, mechanical, photocopying, recording or otherwise without the prior written permission of Guardian Safety.

  1. Acceptance of Terms & Conditions

When you enrol for a course with Guardian Safety whether it be by telephone, post or online it is a condition of all enrolments that you have read, understood and accepted these Terms & Conditions.

  1. General

These terms and governed by and shall be construed in accordance with Irish Law. Any dispute arising between us under or in connection with these Terms shall be subject to the non – exclusive jurisdiction of the Irish courts. These Terms constitute the entire agreement between us in relation to the provision by us to you of a course and they replace and supersede any prior arrangements between us in relation to the publication.
You acknowledge that you are not relying on any statement made by us or any of our representatives with regard to the course other than those expressly set out in these Terms.

Privacy Policy

Guardian Safety fully respects your right to privacy and will not collect any personal information about you on this website without your clear permission.
Any personal information which you volunteer to Guardian Safety (via this website which runs through a secure systems (Podio Citrix) for processing orders will be treated with the highest standards of security and confidentiality, strictly in accordance with the Republic of Ireland`s Data Protection Act, 1988 & 2003 and ( GDPR effective form 25th of May 2018). You have the right of access to, and the right to correct any inaccuracies in personal information we may hold about you.

By simply visiting our website you do not disclose, nor do we collect personal information about you. However, from time to time, we may collect website traffic details, and we use this data at an aggregate level in order to help us to improve our website optimisation and Google AdWords.

Where you do give us personal information (such as your name, email address, work address, phone number, and/or other contact information), you consent to us storing your personal information for:

  • Processing a course booking that you have made through our websites.
    • Processing other requests from you such as information you are seeking about particular services we offer.
    • Sending you other communications about our company, its services and other relevant information, such as through opt-in email newsletters that you have agreed to receive, and which also give clear unsubscribe options.

Security Information

To ensure the highest level of security of information passing between our customers and Guardian safety, we use the services of our Secure Data Processor (Citrix Podio). The Advanced Encryption Standard (AES) is used with a 256-bit key to encrypt sensitive information that must later be available to authorized users in plaintext form. Passwords are secured through a podio.com. Podio security White Paper 4 uniquely salted, one-way (irreversible) password hashing mechanism that ensures protection against exposure even to internal personnel with access to the storage systems and/or encryption keys. Every file uploaded to Podio is encrypted with AES256 before being transferred to an Amazon Web Services (AWS) S3 repository. Beyond the security safeguards implemented within AWS , the encryption mechanism ensures the privacy of file content. Database backups are encrypted in the same manner as uploaded files.
